A SENIOR living community operator agreed to pay an undisclosed amount to settle a class action lawsuit regarding a data breach.

ACTS Retirement Services clients and employees filed the suit, claiming the company failed to protect personal information from a security breach.

The April 2022 breach allegedly compromised names, Social Security numbers, account numbers, treatment information, and other sensitive data.

ACTS denied any wrongdoing but agreed to pay as much as $3,850 to affected individuals.

PAYMENT BREAKDOWN

Class members can receive up to $350 for documented out-of-pocket expenses such as bank fees and credit expenses.

This includes up to three hours of lost time, compensated at $25 per hour.

To claim lost time, they must have spent at least one full hour dealing with issues stemming from the breach.

Those who experienced documented monetary losses due to things such as fraud or identity theft can receive up to $3,500.

However, the claimant must have made reasonable efforts to avoid or seek reimbursement for the loss.

All class members are also eligible for two years of free credit monitoring services.

The deadline to file a claim is May 1.

Eligible individuals may have received notices of the data breach in July 2022 and October 2022, informing them that their information was potentially compromised.

In a similar settlement, Convergent Outsourcing, a debt-collection agency, agreed to pay $2.45 million after a data breach.

Consumers claimed the company, which has an F rating on the Better Business Bureau, failed to prevent the June 2022 data breach by not implementing any reasonable cybersecurity measures.

The plaintiffs argued that the breach leaked Social Security numbers, financial account information, and other sensitive data. 

Convergent denied any wrongdoing but agreed to pay as much as $11,500 to each affected client.

Those who are eligible to file a claim should have gotten a postcard detailing the settlement and payment options.

Eligible class members can get up to $1,500 for "ordinary data breach losses," which are defined as losses from fraud or identity theft, credit expenses, bank fees, communication charges, and travel expenses.

They can also get up to 10 hours of lost time at a rate of $30 per hour.

Some consumers might be eligible to claim as much as an additional $10,000 for "extraordinary losses."

These include identity theft damages, fraudulent damages, falsified tax returns, and other misuse of personal information.

The final day to file a claim is June 19, 2024.
