An ELDERLY man suffering from a sleep disorder began using a marijuana vape after a series of solutions failed him.

Little did he know, the innocent recommendation from his grandson would nearly lead to him getting evicted from his Missouri home.

When Bob Trigg began experiencing sleep problems, he sought answers from an overnight sleep clinic that diagnosed him with periodic limb movement disorder, reported the St. Louis Post-Dispatch.

He was also told he had sleep apnea, but multiple medications later, and a breathing machine, proved fruitless for the 82-year-old.

That's until a suggestion from his grandson changed everything.

"I didn't know what a vape pen was," Trigg told the St. Louis Post-Dispatch, but he knew it helped him sleep, though he had to smoke it before bed because it caused dizziness.

One night, Trigg fell getting into bed, and was diagnosed with Covid-19.

On him was the vape pen, something paramedics noted and kept a record of.

When he returned back to his home, a senior living facility in Dardenne Prairie, he was told he was being evicted, reported the St. Louis Post-Dispatch.

A provision in Trigg's lease at the St. William Apartments II bans marijuana, the outlet reported, but Trigg, who'd been living there for years, had no idea.

"I was just trying to get some sleep," he told the St. Louis Post-Dispatch. "I don't think I did anything wrong."

Having never been evicted before, he was dumbfounded and began looking for apartments out of his price range.

He faced an impossible option: pay $1,400 for a new apartment, compared to his current $525 monthly, including utilities.

To make matters worse, he faced paying double his rent, or the apartment's "market rate" according to his eviction lawsuit, reported the St. Louis Post-Dispatch.

The U.S. Sun reached out to St. William Apartments II in a request for comment.

SEEKING A SOLUTION

In a state of panic, Trigg reached out to his former classmate, and attorney, Stephen Hanlon, aka "Zeus."

With several confidants in his corner, he prepared for a legal battle against the senior home run by Cardinal Ritter Senior Services, an arm of Catholic Charities in St. Louis.

"It borders on being silly," lifelong friend Bill Pautler told the St. Louis Post-Dispatch. "He wasn't hurting anybody."

Camilla Moreno Jimenez, a third-year law student who took on the case, told the St. Louis Post-Dispatch that the fight was all about keeping Trigg comfortable.

"It became apparent that the case was about what's best for him in the long term," she said.

With marijuana legalized in Missouri in 2022, Trigg's lawyers filed a motion to dismiss the eviction.

Though concerns about the Archdiocese being involved weighed on Trigg's lawyers, the case was closed when attorneys decided he could continue living in his apartment as long as he abided by the rule prohibiting the use of marijuana.
